Ganderbal court rejects anticipatory bail to alleged fraudster

The accused is from outside the state allegedly running a fraud company and has been escaping his arrest since the registration of FIR. “He has cheated the complainant and received an amount of Rs 1 lakh from him.

Principal district and sessions judge Ganderbal, Raja Shujaat Ali Khan, rejected anticipatory bail application of an outside state person alleged to have duped a man from Kangan.

According to police a complaint was lodged by one Mir Mushtaq Ahmed son of Ghulam Ahmed of Satruna Kangan alleging that he had received a phone call from the accused, a resident of Okhla, New Delhi, asking him to transfer an amount of Rs 1 lakh which he did on the promise that he would get “benefit of a mobile tower at his home.” Following which a case was registered and investigation taken up. 

While hearing both the sides, the court observed the report sought from police reveals that the petitioner who is seeking pre-arrest bail under section 497-A Cr.PC is involved in the commission of offence punishable under sections 420, 467,468,120-B RPC read with 66 I.T. Act arising out of FIR number 85 of 2015 at police station Kangan. 

The accused is from outside the state allegedly running a fraud company and has been escaping his arrest since the registration of FIR.  “He has cheated the complainant and received an amount of Rs 1 lakh from him.

Public prosecutor Tanveer Ahmed resisted the bail application on the ground that the accused has committed very heinous and non-bailable offence which is not only against the individual but also against the society.

“The investigation of the case is in progress. Therefore, the accused-petitioner is not entitled to the liberty of bail,” with these observations the Court rejected the bail application.
