BJP to press for revocation of Article 35A

Bharatiya Janata Party on Thursday said that it would forcefully oppose Article 35A in the Supreme Court and press for its revocation.

Addressing a news conference here BJP state chief spokesperson, Sunil Sethi said, “The situation was different when we were in government with PDP. We had to follow the Agenda of Alliance it was mentioned in the AoA that we will maintain status quo, but now the situation has changed. Neither we are in the government and nor we are bound by the AoA, therefore we will stick to our old stand and forcefully oppose Article 35A in the Supreme Court.” 

“Now, we are free to plead in the court which we believe is right,” he said.   

The BJP chief spokesperson also said that some Kashmir based parties including the National Conference (NC) are “misleading” people by saying that “J&K’s relationship with India will end if Article 35A is revoked”.

Sethi said that Article 35A in no way defines J&K’s relationship with India. “It is the Instrument of Accession which defines state’s relationship with India and not Article 370 and Article 35-A,” Sethi said.

“Article 1 of Constitution of India clearly mentions that J&K is part of India like any other state and Section 3 of Constitution of J&K clearly states that J&K is an integral part of India,” Sethi said.

“The Instrument of Accession defines state’s relationship with India,” he added.

Referring to Wes Pakistan Refugees, who are settled in Jammu, the BJP spokesman said, “It was NC government led by late Sheikh Muhammad Abdullah which gave lands to WPRs and settled them in the state. The then government had also promised them that they would be provided state subjects. Now the NC is misleading people.”

He questioned, “On which basis the NC is now defending Article 35-A,” he added. 

Sethi said that Article 35A would have to go as it is a “main hindrance” in state’s development and it promotes inequality. “Constitutionally Article 35-A cannot sustain in the court and legally also it cannot be defended,” he said adding, “The Kashmir politicians know this and that is why they are provoking people against the Supreme Court”.
