District Consumer Forum, Srinagar Wednesday directed Air India to pay Rs 15,000 for causing ‘mental agony’ to its passengers after finding it “deficient of services.”

Ghulam Hassan Bhat of BreinNishat had filed a complaint before the forum in 2013 that after returning from pilgrimage (Hajj 2013) through Air Indian flight, he along with his co-passengers was scheduled to land at Delhi.

In his complaint, he had stated that after their arrival at New Delhi Airport, the authorities airlifted them to Srinagar on the same day through other airline of Air India.

As per complaint, he has two luggage bags contained dates and the other valuable articles. “However, to the dismay of the complainant one bag containing the valuable articles was found missing at Srinagar Airport.”

He had informed the concerned authorities of Air India at Srinagar airport about the matter and also submitted a written application.

He alleged that he had time and again approached the authorities regarding the missing bag but there was cold response from the airline. 

“Thus, having been subjected to severe mental pain and agony, I was forced to institute this complaint both for deficiency of service as also the unfair trade practice resorted to by the OPs as envisaged under the J&K Consumer Protection Act 1987,” reads complaint.

He had sought value of baggage to the tune of Rs 30,000 along with sum of Rs 2.25 lac as alleviation of the grievances.

After examining the evidence and witnesses, the forum presided over by Muhammad Ashraf Malik (Retired principal district and session judge) found Air India guilty of deficiency of service.

“Opposite parties (Air India ) are directed to pay Rs 30,000 to the complainant as value of missing baggage; Rs 15,000 as compensation for mental agony and harassment and pay Rs 5000 as litigation charges,” the forum said.

It added that the order shall be complied within one month from the date of receipt of its certified copy, failing which, the amounts shall carry interest @ 12 percent from the date of default till actual payment/realization.
